Terms of Service

Welcome to GetMyQuotation Technologies Private Limited ("GMQ", "Company", "We", "Us", "Our"). These Terms of Service ("Terms") constitute a legally binding and enforceable agreement under the Indian Contract Act, 1872, the Information Technology Act, 2000, and the rules framed thereunder, including the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, governing Your access to and use of the GMQ website, mobile applications, dashboards, tools, and all related services (collectively, the "Platform").

By accessing, browsing, registering on, or using the Platform in any manner whatsoever, You acknowledge that You have read, understood, and expressly agree to be bound by these Terms. In the event that You do not consent to these terms, You are required to immediately cease and refrain from any further access to or use of the Platform.

"User" means any natural or juristic person accessing or using the Platform, including Customers and Vendors.

"Customer" means any person or entity seeking quotations or services through the Platform.

"Vendor" / "Service Provider" / "GetMyQuotation Technologies Private Limited Partner" / "GMQ Partner" means any professional, contractor, firm, company, or business entity offering quotations or services through the Platform.

"Quotation" means a non-binding, indicative estimate submitted by a Vendor in response to a Customer requirement.

"Lead" means information relating to a Customer requirement shared with Vendors for consideration.

"Transaction" means any agreement, contract, or commercial arrangement entered into directly between a Customer and a Vendor.

Headings are for convenience only and shall not affect interpretation.

GMQ is a technology intermediary as defined under Section 2(1)(w) of the Information Technology Act, 2000.

GMQ solely provides a digital platform enabling Customers and Vendors to connect, communicate, and exchange information.

GMQ does not provide, perform, supervise, control, verify, endorse, guarantee, or warrant any services offered by Vendors, nor does it act as a contractor, service provider, employer, agent, broker, partner, or fiduciary of any User.

All Transactions are concluded independently between Customers and Vendors. GMQ is not a party to any such Transactions.

Users may be required to create an account to access certain features of the Platform.

Users agree to provide true, accurate, current, and complete information and to update such information as necessary.

Users are solely responsible for maintaining confidentiality of login credentials and for all activities conducted through their account.

Users acknowledge and agree that the Platform may automatically collect technical and usage-related information including Internet Protocol (IP) address, browser type, device identifiers, operating system details, and user-agent information for purposes of security, fraud prevention, system administration, analytics, and compliance with applicable law.

Customers may post project requirements describing the scope of work sought.

Vendors may submit Quotations at their discretion. GMQ does not guarantee receipt, acceptance, or conversion of any Quotation.

Negotiation, finalization, execution, and enforcement of any agreement are solely the responsibility of the Customer and Vendor.

Vendors shall perform services with reasonable skill, care, and diligence in accordance with industry standards.

Vendors represent and warrant compliance with all applicable laws, licenses, permits, insurance, labour, tax, and safety regulations.

Vendors operate as independent contractors and nothing herein shall be deemed to create an employment, agency, partnership, or joint venture relationship with GMQ.

Vendors acknowledge that GMQ operates on a lead-generation and information-access model.

Leads do not constitute assurances of work, revenue, or contract award.

All fees charged by GMQ, whether per lead, subscription, promotional, or otherwise, are non-refundable and non-adjustable, irrespective of outcome.

Any circumvention of the Platform to avoid fees shall constitute a material breach.

Vendors expressly acknowledge that lead allocation is conducted through automated or internal platform logic based on multiple parameters including, without limitation, service category, geographic relevance, vendor availability, historical performance indicators, subscription status, and system constraints, and that GMQ does not guarantee allocation of any minimum number of leads, exclusive leads, or conversion of leads into business.

GMQ does not endorse, verify, certify, or recommend any Vendor or Customer.

Any information, descriptions, quotations, timelines, or representations displayed on the Platform are User-generated and GMQ makes no warranty as to their accuracy or reliability.

Any reliance placed on such information is strictly at the User's own risk.

Any "Verified", "Trusted", or similar badge or label displayed on the Platform in respect of a Vendor signifies only that certain documents or information have been submitted by such Vendor to GMQ and shall not be construed as an independent verification, certification, endorsement, warranty, or guarantee of quality, competence, legality, or performance by GMQ.

The Platform may provide a rating, review, or feedback mechanism allowing Customers to share their experiences with Vendors. Such ratings and reviews are user-generated content and reflect individual opinions only.

GMQ does not verify, moderate, or guarantee the accuracy of such feedback and shall not be obligated to resolve disputes arising from ratings or reviews.

Vendors may raise concerns regarding reviews through the grievance mechanism; however, GMQ reserves the right to retain, remove, or modify such content in accordance with applicable law and internal policies.

Users acknowledge that communications initiated through the Platform, including automated or manual emails, WhatsApp messages, notifications, and in-platform messages between Customers and Vendors, may be logged, stored, and tracked for purposes of service delivery, lead allocation, security, fraud prevention, quality assurance, and regulatory compliance.

Users expressly consent to receipt of such automated communications and acknowledge that GMQ may monitor, record, or retain such communications for a limited duration in accordance with its Privacy Policy and applicable law.

Users acknowledge that the Platform utilizes artificial intelligence and machine learning technologies to analyze project requirements, generate Bill of Quantities (BOQ), create scope of work descriptions, provide cost estimates, and offer automated recommendations. Users further acknowledge that such AI processing may occur on servers located in secure foreign jurisdictions.

Such AI-generated content is provided for convenience and informational purposes only. GMQ makes no warranty, representation, or guarantee as to the accuracy, completeness, or suitability of any AI-generated scope, BOQ, specification, or recommendation.

Users are solely responsible for verifying and confirming all AI-generated content with the relevant Vendor or Customer before finalizing any transaction, quotation, or agreement.

GMQ shall not be liable for any errors, omissions, or inaccuracies in AI-generated content, or for any decisions made in reliance upon such content.

GMQ SHALL HAVE NO LIABILITY OR RESPONSIBILITY WHATSOEVER FOR:

• Delays, defective workmanship, or quality issues

• Material substitutions or deviations from quotations

• Vendor misconduct, negligence, or fraud

• Payment disputes or refunds

• Personal injury or property damage

• Regulatory non-compliance by Vendors

• Any acts or omissions of any User

Users agree not to misuse the Platform, including but not limited to:

• Engaging in fraudulent activity or spamming

• Sending unsolicited communications

• Misrepresenting identity

• Posting false requirements or quotations

• Harvesting data or attempting to bypass lead fees

• Reverse engineering the Platform

• Using bots, scripts, scrapers, or other automated means to access or interact with the Platform

Any such activity shall constitute a material breach and may result in immediate suspension or termination of access without notice.

The Platform is intended solely for use by individuals who are eighteen (18) years of age or older. By accessing or using the Platform, Users represent and warrant that they meet this eligibility requirement.

All payments between Customers and Vendors are independent of GMQ.

GMQ does not process, guarantee, or mediate payments unless expressly stated.

Users are solely responsible for applicable taxes.

All intellectual property in the Platform vests exclusively with GMQ or its licensors.

Users are granted a limited, revocable, non-transferable license to access the Platform.

To the maximum extent permitted by law, GMQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

GMQ's aggregate liability, if any, shall not exceed the fees paid to GMQ by the User in the preceding twelve (12) months.

Users agree to indemnify, defend, and hold harmless GMQ from all claims, losses, damages, penalties, costs, and legal expenses arising from their use of the Platform or breach of these Terms.

GMQ shall not be liable for failure or delay caused by events beyond its reasonable control, including acts of God, government actions, system failures, or cyber incidents.

Disputes between Customers and Vendors shall be resolved exclusively between such parties.

Disputes with GMQ shall first be attempted to be resolved amicably. If unresolved within thirty (30) days, such disputes shall be referred to binding arbitration under the Arbitration and Conciliation Act, 1996.

Seat and venue of arbitration: New Delhi. Language: English. Arbitrator: Sole arbitrator appointed by GMQ.

Users acknowledge that GMQ is not a service provider with respect to Vendor services under the Consumer Protection Act, 2019.

GMQ may suspend or terminate access to the Platform, with or without notice, upon:

• Breach of these Terms

• Misuse of the Platform

• Violation of applicable law

• Engagement in prohibited conduct

GMQ retains all other rights under law.

These Terms shall be governed by the laws of India.

Courts at New Delhi shall have exclusive jurisdiction, subject to arbitration provisions.

GMQ may assign these Terms without consent. Invalid provisions shall be severed. Waiver of any breach shall not constitute waiver of future breaches.

GMQ may modify these Terms at any time. Continued use constitutes acceptance.
